Agreement to Terms

By accessing or using the Kiss Mortgage website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

Use License

Permission is granted to access the public materials on Kiss Mortgage's website for personal, non-commercial viewing. A registered account grants additional access to the features described in these terms. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the website's content, branding, or materials for any commercial purpose or public display, except as expressly permitted for your registered account (for example, an invited real estate agent using the partner portal)
• Attempt to reverse engineer any software contained on the website
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

Loan Officer Services

Kiss Mortgage is a personal brand and website operated by a loan officer sponsored by Paramount Residential Mortgage Group, Inc. (PRMG), a licensed direct lender. This website is used to market that personal brand and to help facilitate the mortgage process. Kiss Mortgage is not a lender and does not originate, underwrite, or fund mortgage loans. By using this website, you understand and agree that:

• Any mortgage loan is originated, underwritten, and funded by PRMG, not by Kiss Mortgage
• All loan applications are subject to PRMG's credit approval and underwriting guidelines
• Rates and terms are set by the lender and are subject to change without notice
• Final loan approval is subject to the lender's underwriting requirements and conditions
• You must provide accurate and complete information in all applications and communications

Because any mortgage loan is offered by PRMG, your use of PRMG's website, application, and loan products is also governed by PRMG's Terms of Use.

Website and App Features

Kiss Mortgage provides a website and web application to market the loan officer's personal brand and to help you share information and stay organized during the mortgage process. Features may be added, changed, or discontinued. Current functionality includes:

• Public pages about home purchase, refinance, first-time homebuying, investors, and home equity, plus contact and inquiry forms
• Mortgage calculators, market information, and educational content. These tools provide estimates only and are not an offer, rate lock, or loan approval
• An optional prequalification questionnaire. Completing it does not create a loan application with PRMG and is not a credit decision
• Secure document-upload links that the loan officer or team may send you, which you can use with or without signing in
• Newsletter signup and, where available, an informational chatbot
• A registered client portal (dashboard) where you can view loan progress and next steps, manage your profile, upload and review documents, respond to document requests, review prequalification information, and start or continue loan-application intake to help prepare information for the lender
• Calculators, partner resources, and in-app notifications in the client portal, plus email or SMS communications you have consented to
• Invited real estate agent partners may use a partner portal to refer leads, track deals, and access partner resources, subject to RESPA and any partner agreement
• Staff accounts for authorized loan officers, processors, and administrators to operate the CRM and support your file

Using this website or app, including calculators, questionnaires, document uploads, or a registered account, does not mean Kiss Mortgage is your lender and does not guarantee a loan, rate, or approval from PRMG. Official loan origination, underwriting, and funding are handled by PRMG.

Registered Accounts

Some features require a registered account. You may create an account by signing up on the website, at the end of the prequalification questionnaire, or by accepting an invitation from the team.

• You must be at least 18 years old and provide accurate, current information
• You are responsible for keeping your login credentials confidential and for activity that occurs under your account. Notify us promptly if you believe your account has been compromised
• Do not share your account, impersonate another person, or access another user's account
• Use your account only for lawful purposes related to your mortgage inquiry or loan process, or, if you were invited as a partner or team member, for your authorized role
• We may suspend or terminate access if we believe these terms have been violated, or for security, legal, or operational reasons
• You may request account deletion from your account settings. We may retain information as required by law, compliance, or the lender's records-retention obligations
• Creating or using an account does not create a lender-borrower relationship with Kiss Mortgage and is not a commitment by PRMG to lend

SMS Text Messaging Program

If you provide a mobile phone number and opt in on Kiss Mortgage's website, application forms, or client portal, you agree to these SMS terms in addition to the rest of this agreement.

• You may receive automated text messages (SMS) about your mortgage inquiry and loan application, including secure document-upload links and reminders, loan status and account notifications, and occasional marketing messages where you have given consent. Messages are sent using automated SMS technology, including Sinch.
• Message frequency varies depending on your loan activity; you may receive multiple messages during an active document request or application.
• Message and data rates may apply. Consent to receive text messages is not a condition of purchase or obtaining a mortgage.
• You may opt out at any time by replying STOP to any message. After you opt out, you may receive one final confirmation text. Reply HELP for assistance with the messaging program.
• Wireless carriers are not liable for delayed or undelivered messages. For customer care, use the contact information in the Contact Information section below.

Disclaimer

The materials on Kiss Mortgage's website are provided on an 'as is' basis. Kiss Mortgage makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Limitations

In no event shall Kiss Mortgage or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Kiss Mortgage's website, even if Kiss Mortgage or a Kiss Mortgage authorized representative has been notified orally or in writing of the possibility of such damage.
